Covenants are included in the parcel files for all parcels at lands and survey for properties within Patrick's Island. The restrictive covenants are set out below:
General
- Not to erect or maintain on the lot any building other than a single dwelling house with a minimum floor area of two thousand five hundred (2,500) square feet.
- Not to erect any dwelling house with a zinc roof.
- Not to erect, place, or alter any building on the lot unless the quality of workmanship and materials and harmony of external design conforms to good and proficient building practices.
- Unless otherwise designated as "commercial" by the original developer, all lots shall only be used for residential purposes. Not to use any dwelling house or building erected or to be erected on the lot other than for the purpose of a single dwelling house and not to do any act or thing on the lot which shall be a nuisance to the owners or occupiers of any of the lots forming part of the subdivision.
- Not to allow the right of way of roadways and parkland to fall into disrepair and to maintain the said right of way common with the owners or occupiers of the lots forming part of the subdivision.
- Not to interrupt any construction work on the lot for more than two (2) months.
- Not to keep within the dwelling house or curtilage any livestock or animals other than the usual household pets.
- Not to subdivide the said lot or construct thereon any chain link fence.
- Not to permit the accumulation of garbage, trash, or disused vehicle of any kind on the lot, nor burn any garbage, trash or rubbish thereon.
- Not to erect any clothes lines, yard equipment or storage piles unless screened by a service yard, drying yard, or other similar facility to conceal them from view of neighboring lots, roads or other property.
- Not to erect any sign, advertisement, billboard or advertising structure of any kind without consent. If consent has not been given, the signs, advertisements, billboards or structure may be removed.
- Not to use boats for any commercial use on the lot or in the canal.
- Not to dock any commercial boats on the lot or in the canal.
- Not to live aboard any boats moored on the canal or waterways.
Maintenance Provisions
- The proprietor for the time being of the lot and successors, at all times, will make a contribution, along with the owners of the other lots in Patrick's Island, towards the cost of maintenance.
- In this context, the following words shall bear the following meanings:
- "Contribution" shall mean the amount payable by a lot owners within the subdivision and shall be assessed in accordance herewith. The total cost of maintenance as aforesaid shall be ascertained and then divided between the lots comprised in the subdivision in proportion to the size of the lots, and each lot therein shall bear the cost assigned to it.
- "Maintenance" shall include the following:
- Facility: Any utility or service to be used for the benefit of all the owners for the time of being of the lots and the common areas.
- Landscaping: The care of the open and garden areas including the employment of necessary labour for watering the said areas, a reasonable volume of soil, plants and the treatment thereof may be incurred without prior consultation with the contributors as hereinafter provided.
- Road: The repairs of the road within the said subdivision so as to keep it at all times in reasonable condition for use by motor vehicles.
- Security: The employment of a security guard and maintaining or renewing gates, entrances and guard house.
- Water: The disposal of surface water from the said roads, as well as storm water drains.
3. The contributions, as aforesaid, shall be assessed periodically (but not more more often than monthly) and be payable within twenty-one (21) days of demand by the contributor to the original developer or any home owner's association and shall thereafter be recoverable by action.
